These terms apply to the use of the TourGuide app. By using the app, you agree to these terms. So please read them carefully.

1. Definitions

• TourGuide, we, us: [company name], the provider of the app.
• You, user: anyone who uses the app.
• Tour: a walking route with stops, stories and audio that the app creates for you.

2. Using the app

You may use the app for personal, non-commercial purposes. You do not use the app in a way that disrupts how it works, and you do not try to misuse the app or our servers.

3. Your account

To create tours you need an account, which you create with Apple or Google. You are responsible for the use of your account. In case of misuse, we may block your account.

4. Tours and content

Tours are created automatically with the help of AI, based on public sources such as Wikipedia. We do our best to keep the information accurate and up to date, but we cannot guarantee that everything is correct. Places may be closed, under renovation or inaccessible.

A tour we create for you may also be shared with other users who request a tour with the same settings and the same starting point.

5. Safety on the way

Always pay attention to traffic and your surroundings, and follow the traffic rules. The route is a suggestion: you decide whether a road is safe and accessible. Do not enter private property without permission.

6. Prices and payment

Exploring and your first tour are free. If paid features are added, you will always see the price in the app beforehand. Payments go through the App Store or Google Play and fall under their terms.

7. Intellectual property

The app, the design and the audio belong to TourGuide. Texts and photos from Wikipedia and Wikimedia Commons fall under their own open licences; the attribution is shown in the app. Maps are © Mapbox and © OpenStreetMap.

8. Liability

We are not liable for damage resulting from the use of the app or from incorrect information in a tour, unless there is intent or gross negligence. Our liability is in all cases limited to the amount you paid us in the preceding twelve months.

9. Changes and termination

We may change these terms and the app. We will let you know in advance about major changes. You can stop using the app at any time and have your account deleted via hallo@tourguide.app.

10. Applicable law

These terms are governed by Dutch law. Disputes are submitted to the competent court in the Netherlands, but we would rather work it out together first.
